Hiring a software development company in Poland can reduce cost, but that is not the best reason. The stronger argument is access to experienced engineers in a European legal framework, with enough working-hour overlap to make decisions in real time. Poland is not a shortcut around technical leadership. If a vendor sells cheap capacity instead of ownership, you are buying a larger backlog and a future rewrite.

What software development in Poland actually costs
Public rate pages often mix salaries, contractor compensation, and agency invoices. Those are different numbers.
A July 2026 contract-data report based on more than 2,400 vetted developers places Polish developer rates between $25 and $65 per hour. It reports an average of $41.70 for senior developers and about $50.50 for strong seniors. Treat these as direct talent benchmarks, not a guaranteed agency price.
A separate 2025 survey of nearly 5,000 Polish IT workers found that 38.5% worked through B2B contracts and 51% of those respondents had no client-funded paid leave. A low contractor rate can therefore hide downtime, replacement, and retention risk.

Do not reject a firm because its invoice exceeds a salary calculator. Reject it when the firm cannot explain the difference. A credible quote identifies engineering, QA, management, infrastructure, and assumptions. It also defines who can approve work outside the original scope.
Nearshore does not automatically mean low risk
Country-level reputation cannot replace vendor due diligence. Community discussions about outsourced development quality repeatedly return to the same issue: incentives, communication, and management matter more than a country label.
Poland makes sense when you need European working-hour overlap, EU contracts, and an established B2B technology market. It makes less sense when the lowest hourly rate is the main criterion. Then both sides optimize for billable output rather than product value.
Put ownership into the contract
The contract must describe what you receive, when you receive it, and what happens when the relationship ends.
Under Article 53 of the Polish Copyright Act, a transfer of economic copyright must be made in writing under pain of nullity. The English text published by the Polish Copyright Office also distinguishes a transfer from a licence. Do not rely on a sentence saying that you “own the product.” Have counsel specify the source code, designs, documentation, database structure, and relevant fields of exploitation.
Your contract should answer these questions:
- Who owns the Git repository, cloud account, domains, analytics, and deployment keys?
- When do economic rights transfer: after each paid invoice or only after final acceptance?
- Can the company use subcontractors, and must it identify them?
- What counts as acceptance, and how long do you have to report defects?
- Is there a warranty period for bugs, and what is excluded as a change request?
- What documentation and handover support are included when the agreement ends?
- Can the team reuse proprietary code or confidential product information elsewhere?
If the company will process personal data on your behalf, Article 28 GDPR requires a binding processor contract with defined subject matter, duration, purpose, data categories, and controller rights. The official GDPR text also requires equivalent obligations for subprocessors. Ask where production data, backups, logs, and support tools are hosted. “We are in the EU” is not a data-processing plan.

Choose the engagement model by uncertainty
A fixed price works when scope is stable and testable. An untested product usually needs time and materials, visible work, and the ability to stop without losing the code. A dedicated team only makes sense with product leadership and enough work for several people.

Red flags before you hire
Use paid discovery or a small production task to test the relationship. Good firms should be paid for serious thinking.
- The estimate arrives without questions: The team is pricing your document, not understanding the problem.
- Every developer is “senior”: Ask who will write the code, who reviews it, and how much time each person is assigned.
- You cannot meet the delivery team: A salesperson should not be your only technical contact.
- The vendor owns the repository or infrastructure: Create the accounts yourself and grant access.
- There is no exit procedure: Handover should be a contract term, not a favour.
- Progress means hours reported: Ask for working software, reviewed pull requests, tests, and deployment evidence.
- The company promises an exact launch date before discovery: Precision without evidence is sales theatre.
Ask a senior engineer to walk through a recent system: what failed, what changed after launch, and what they would build differently. A technology list proves little. A clear account of a corrected mistake proves experience.
A practical hiring process
- Write a one-page brief covering the user, outcome, constraints, and current systems.
- Shortlist three companies with relevant production work.
- Run a technical call with the people expected to deliver the project.
- Request a written scope containing assumptions, exclusions, team roles, milestones, and the change process.
- Review the contract for IP, data processing, infrastructure ownership, acceptance, warranty, and termination.
- Start with paid discovery or one small feature that reaches production.
- Continue only if delivery evidence matches the proposal.
In our own delivery work, one of the systems that has aged best is a live auction platform built with PHP and MySQL. It is still running in production because the bidding rules, ownership, and operating boundaries were clear. A fashionable stack would not have rescued a confused contract or an undefined product.
The hiring decision
Hire a software development company in Poland for accountable delivery, not discounted keystrokes. An agency rate should cover review, QA, continuity, and commercial responsibility. Verify that those services exist instead of assuming the margin buys them.
The best vendor is not the one with the lowest estimate. It is the one that makes risk visible, puts ownership in writing, and can leave without taking your product with it.
